These Terms govern your access to and use of the Asialy Platform, including all content, features, and services.
By creating an account or accessing Asialy, you agree to be legally bound by these Terms.

If you do not agree, do not use Asialy.

1. Eligibility

You must be:

• At least 18 years old, and

• Legally able to enter a binding contract.

We may request identity or age verification at any time.

2. Account Registration

To use Asialy, you must:

• Provide accurate and complete information

• Maintain security of your account

• Not share your login credentials with others

You are responsible for all activity occurring under your account.

We may suspend or terminate accounts that:

• Provide false information

• Impersonate another person

• Attempt to bypass age verification

• Violate these Terms

3. User Types

Asialy includes two types of users:

A. Creators

Users who upload content, set subscription prices, or earn revenue.

B. Fans

Users who subscribe to Creators, purchase content, or otherwise support Creators.

4. User-Generated Content (UGC)

Asialy is a UGC platform.
Creators are solely responsible for the content they upload.

You agree not to upload content that:

• Depicts anyone under 18

• Violates copyright or trademarks

• Contains hate speech or harassment

• Contains threats or illegal activities

• Reveals private personal information (doxxing)

• Promotes self-harm

• Violates any law or regulation

We may remove content or terminate accounts that violate laws or platform policies.

You retain ownership of all UGC you upload.
By uploading content, you grant Asialy a limited, non-exclusive, worldwide license to display and host the content solely for platform operation.

5. Prohibited Conduct

You agree NOT to:

• Copy, record, or distribute any Creator content without permission

• Upload stolen, copyrighted, or illegal material

• Attempt to circumvent paywalls

• Use bots or automated tools

• Engage in fraud or chargeback abuse

• Misrepresent your identity or age

• Use Asialy for escort services or prostitution

• Post or solicit illegal content

Violation may result in account termination.

6. Payments, Subscriptions & Refunds

A. Payment Processors

Payments on Asialy are made through third-party processors such as Stripe or CCBill, depending on availability and region.

We do not store full credit card details.

B. Subscriptions

Creators may offer monthly subscription access to their content.

When subscribing:

• You authorize recurring charges

• Your subscription renews automatically each period

• You may cancel anytime, but past payments are non-refundable

C. Pay-Per-View (PPV) & Tips

Additional content or features may be purchased on a one-time basis.

D. Refunds

Due to the nature of digital content:

• All payments are final and non-refundable, except where required by law.

• Chargeback abuse may result in account termination.

7. Creator Earnings & Payouts

Creators may earn revenue through:

• Subscriptions

• PPV content

• Tips

• Other available features

To withdraw earnings, Creators must:

• Complete identity verification

• Provide payout information

• Comply with tax laws

• Comply with 2257 and safety guidelines

The Platform may deduct:

• Payment processor fees

• Platform fees

• Chargebacks or fraud losses

We reserve the right to hold or freeze payouts:

• If required by law

• During investigation of Terms violations

• For fraud prevention

• For underage or illegal content reports

8. Intellectual Property

Asialy owns:

• Website design

• Branding

• Layout, interface, code

• Logos, trademarks

You may not:

• Copy

• Modify

• Reproduce

• Distribute
  any part of the Website without written permission.

Creators retain rights to their own content.
Fans receive a limited license to view purchased content for personal, non-commercial use.

9. DMCA & Copyright Policy

If you believe your copyrighted material is being infringed, you may submit a DMCA Notice.

Asialy complies with the Digital Millennium Copyright Act (DMCA) and maintains a designated agent.

Repeat infringers may have accounts permanently removed.

10. 18 U.S.C. §2257 Compliance

Creators are solely responsible for ensuring that all persons appearing in their content are 18 or older.

Creators must:

• Maintain required age verification records

• Comply with all 2257 obligations

• Not upload content involving minors

Asialy is not the producer of user-uploaded content.

11. Account Termination

We may suspend or terminate your account for:

• Violating these Terms

• Uploading illegal or underage content

• Fraud or chargeback abuse

• Harassment or threats

• Copyright violations

• Security risks or suspicious activity

We may remove or block content at any time.

12. Disclaimer of Warranties

Asialy is provided “AS IS” and “AS AVAILABLE.”

We do not guarantee:

• Continuous operation

• Error-free performance

• Content accuracy

• Availability of any Creator or content

• Specific earnings for Creators

Use of the Website is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any damages arising from your use of the Platform.

• We are not responsible for UGC or user behavior.

• We are not liable for losses from service interruptions, hacked accounts, or third-party actions.

14. Indemnification

You agree to defend and indemnify Asialy against claims arising from:

• Your content

• Your actions

• Your use of the Platform

• Your violation of these Terms

• Your infringement of others’ rights

15. Governing Law & Disputes

These Terms are governed by the laws of the State of California, USA.

Any dispute must be resolved:

• In the state or federal courts located in Los Angeles County

• Unless prohibited by law

16. Changes to These Terms

We may update these Terms at any time.
Continued use of Asialy after changes = acceptance of the updated Terms.
