Digital Millennium Copyright Act (“DMCA”) Policy
Asialy (“the Website”), operated by MZK CAPITAL, LLC, respects the intellectual property rights of others and expects all users (“Creators” and “Fans”) to do the same.
This DMCA Policy explains how copyright infringement claims may be submitted, and how Asialy responds to such notices in compliance with the Digital Millennium Copyright Act (17 U.S.C. § 512).
Asialy is a user-generated content (UGC) platform. All content uploaded to the Website is created, owned, and controlled by the individual users who post it. Asialy does not pre-screen or monitor user submissions and cannot determine whether a particular upload infringes upon someone’s copyright.
However, Asialy will promptly review and remove allegedly infringing material when a valid DMCA notice is received.
1. DMCA Takedown Notices
If you believe that any content on Asialy infringes your copyright, you may submit a DMCA Takedown Notice to our designated DMCA Agent.
Your notification must include the following required information under 17 U.S.C. § 512(c)(3):
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed.
Identification of the allegedly infringing material, including the URL(s) where the content is located.
Your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Incomplete notices may not be processed.

2. Removal of Content
Upon receiving a valid DMCA notice:
The reported content may be temporarily removed or disabled.
The user who posted the content (“Creator”) will be notified and provided with a copy of the DMCA notice.
Repeat infringers may have their accounts suspended or terminated, in accordance with Asialy’s Repeat Infringer Policy.
Asialy does not share the personal information of the reporting party with the uploader beyond what is legally required.
3. Counter-Notification (Restoration Request)
If you believe that your content was removed in error or misidentification, you may submit a DMCA Counter-Notification.
Your counter-notification must include:
Your physical or electronic signature.
Identification of the removed content and its prior location (URL).
A statement under penalty of perjury that you have a good-faith belief that the content was removed as a result of mistake or misidentification.
Your name, address, telephone number, and email address.
A statement that you consent to the jurisdiction of the U.S. federal courts in California and will accept service of process from the person who submitted the original takedown notice.
After receiving a valid Counter-Notification, Asialy may restore the material unless the original complaining party files a court action within 10–14 business days.
4. Repeat Infringer Policy
Asialy enforces a strict Repeat Infringer Policy.
Users who receive multiple valid DMCA takedown notices may have:
Content removed
Account privileges restricted
Accounts permanently terminated
Asialy reserves the right to remove any content that violates copyright laws, even without a formal DMCA notice.
5. Misrepresentations
Under federal law, any person who knowingly submits a false or fraudulent DMCA notice or counter-notice may be liable for damages, including legal fees (17 U.S.C. § 512(f)).
